ITR FILING FOR THE DECEASED TAX PAYER

FILING OF INCOME TAX RETURN OF THE DECEASED PERSON

 In the eventuality of the death of a TAX PAYER his/her last return is required to be filed by the legal heir after getting him/her self registered on the Income Tax Efiling site. The responsibility of payment of tax rests with the legal heir. There have been cases where the IT Dept has raised demand after three to four years from the Family pensioner.    It is therefore necessary to file his/her last return. The method is not complicated and is described below in the succeeding paragraphs.

FAMILY PENSION FOR DAUGHTERS

ELIGIBILITY OF UNMARRIED / WIDOWED / DIVORCED DAUGHTERS FOR GRANT OF FAMILY PENSION

          In accordance with clauses (ii) and (iii) of sub-rule (6) of Rule 54 of the C.C.S. (Pension) Rules, 1972 read with clause (b) of Para 7.2 of this Department’s O.M. No.45/86/97-P&PW (A)-Part I dated the 27th October 1997, son/daughter including widowed/divorced daughter shall be eligible for grant of family pension till he/she attains the age of 25 years or up to the date of his/her marriage/remarriage, whichever is earlier (subject to income criterion to be notified separately). In this connection Govt Letter dated 30 Aug 2004 referes which is reproduced towards the end of this post..

The above provisions were modified with effect from 06 Sep 2007, wherein the unmarried daughters above 25 years of age are also eligible for pension at par with widowed/divorced daughters subject to other conditions being fulfilled and in case  there is no disabled child to receive the family pension.

1. It is a fact of life that we, while in service never bothered about our Retired Phase of Life. We may have been very good professionally Wwith long tails of qualifications, however, are virtually NIX on the issues which bug us all day in and day out during the retired life. During service one had a functional office as well as administrative support which just vanished in thin air, in a short while after one's farewell to arms.
2. Are you, for sure, aware as to what all forms you filled up and sent to AG's branch six months before your superannuation. Wasn't it your Head Clerk who liaised with another unit to copy all these documents from the ones belonging to another recent retiree. Our ignorance would surely lead to many issues which will crop up in a few years. We will then be bash our head here and there to rectify what could have been done easily immediately after retirement. (CONTD)

1.       A large number of pensioners/family pensioners have been facing the problem of delayed payments by banks or paying lesser pension than their entitlement. It's been found to be a very very common problem particularly faced by the Family Pensioners who are generally not aware of their entitlements and the system which pays them the pension. We have seen my pensioners and Family pensioners running to their banks and virtually begging the bank clerks to look into the payments and corrections whereas they are duty bound by explicitly laid down rules too pay the correct pension without any claims from us. The attitude of the bank clerks in most of the banks has generally seen to be rude and indifferent as if they are the ones who are giving the pension to them. (Contd -click below) ----- 

LINKING AADHAAR AND PAN - Simplified

Income Tax (IT) Department simplifies linking PAN with Aadhaar for taxpayers using Income Tax India website. No need to login or be registered on the E-filing website for linking
The Income Tax (IT) Department has made it easy for taxpayers to link their PAN with Aadhaar. Responding to grievances of taxpayers regarding difficulties in linking PAN with Aadhaar as their names did not match in both systems (e.g., names with initials in one and expanded initials in another), the IT Department has come out with a simple solution now.Taxpayers can go to "http://www.incometaxindiaefiling.gov.in/" and click on the link on the Link Aadhaar, provide PAN, Aadhaar number and ENTER NAME EXACTLY AS GIVEN IN AADHAAR CARD (avoid spelling mistakes) and Submit. One can also direclty reach the page  for linking  your aadhaar with your PAN  clicking on "Link Aadhaar" or by selecting the option under services section in their home page.

1.  There have been Many queries from our readers on as to how to work out relief on Arrears of OROP fourth installment, which had been received during the FY 2023-24 while filing the ITR for the current Assessment Year  before 31st of Jul 2024

       NOTE : Just to remind the readers  not to delay filing your return this year as the

 Income Tax department will charge you delay penalty of Rs 5000/- . It is no Rocket

 science but a child’s play. It is very very easy to file the ITR on line, child's play because

 your data is prefilled by the portal and all calculations are done automatically, you

 need to  just put in figures of your pension and income from other sources rest is done

 by the on line software, do veryfy the figures as per interest certs received from the

3.  The installments of OROP-2 lif pertain to the FY 2023-24 will add to your income hence the Tax. 
4.   One can claim rebate to the extent what we would have paid had the arrears were received during the year to which they pertain to. This all done on line while filing the ITR by filling up Form 10-E. However first and foremost carry a check whether it will be of some benefit or not.

5.   It will be beneficcial only if in the previous years you were ina lower bracket.

BHIM - E-PAYMENT MOBILE APP

      Our Prime Minister Shri Narender Modi released the new Mobile Application for Cashless Digital Payments on 30th Dec 2016. The Application has been named BHIM in Commemoration of the birth Anniversary of Dr BR Ambedkar. This application works over the "Unified payment Interface" (UPI) of the banks and is very simple and reliable. This APP has now been upgraded and is available on both Android as well as IOB platforms. It is available in 7 Indian Languages and has been Aadhaar Enabled for payments.

    The money gets transferred direct to the bank account of the merchant or payee instantly from your bank. It uses the Virtual Payment Address (VPA) of the payee like 9999999999@upi where 9999999999 is mobile number of the Payee linked to his bank account. The secondary VPA can also be created hiding the mobile number as imsmart@upi  where its your chosen short name. The application has been updated that It can now transfer money using IFSC Code and account number of the payee in addition to VPA.

ASSURED DECENT LAST RITES SCHEME (ADLRS)

      In order to ensure that the Army Veterans get a decent funeral on death, the services HQs have made a special provision to release some funds from the canteen profits of the Canteen where the veteran had been attached. The necessary instructions have been passed to all Station Canteens on these provisions. The families are advised to contact their CSD(I) Canteens from where their cards have been issued.

A very exhaustive article in http://mycriticalreviews.blogspot.in  explains the very special status given to the Armed forces in Indian Constitution to the extent that in past the Chiefs cautioned the then Prime minister of India to remain within the provisions of the constitution, a guard against the political leadership in becoming a Dictator.  You are already aware that AG's Branch has taken a decision to terminate the AOBF wef 2018. They are thus in the process of refunding your contributions in a sequential manner . Presently they are handling those Veterans who were born in 1943 as also those commissioned up to 1971. The amount that will be refunded is as shown in the schedule below.

ACTION ON OUR PART - Please ring up Army HQ AG's Branch Tel No, - 011 26196217 , which is being promptly attended by a JCO. I got connected with  this number in first attempt. Give your IC No to the JCO, he will immediately check your details on his computer and verify with you and your current postal address will be updated by him in his data base. They will send a letter by post at your updated postal address to obtain your bank details for sending you the cheque once your turn comes up.

Tax Exemption For Disabled Persons,

The Income Tax Act and the Profession Tax Act provides various income tax deductions under Section 80DD, 80DDB and 80U for differently-abled (disabled and handicapped) people.

Most states in India allow a professional tax exemption for any person suffering from a permanent disability.

Section 80DD
Under Section 80DD the expenses on maintenance/ medical treatment of disabled dependents can be claimed as an income tax deduction. Dependents include spouse, children, parents, brothers and sisters and the income tax deduction is valid only if they have not already claimed a benefit under Section 80U. Income-tax Deduction for expenses for partially disabled dependents (severity 40-80%) is allowed up to Rs.75,000 while it goes up to Rs 1.25 lakh if the dependent is over 80% disabled. The plus side is that even if your actual expenses are lesser than Rs 75000 you can claim a full deduction.

CONSTITUTIONAL - STATUS OF ARMED FORCES

Para 310 of the Constitution reads,
"310. (1) Except as expressly provided by this Constitution, every person who is a member of a defence service or of a civil service of the Union or of an all-India service or holds any post connected with defence or any civil post under the Union holds office during the pleasure of the President, and every person who is a member of a civil service of a State or holds any civil post under a State holds office during the pleasure of the Governor 3*** of the State. (2)"

Our understanding of the sentence, would place the member of the Defence Service on top of all others, followed by the civil services and then  by all India services.

Apparently the makers of the constitution had this order in mind, when the above sentence was framed. The meaning of the constitution is quite clear and has clearly indicated the order of precedence. There has been no amendment to this act. 

Any other  office order by the Govt of India which is not in line with the above constitutional provisions is unconstitutional and can be struck down by the Honourable Supreme Court of India.

Keeping this in my mind, it is surprising that the 7CPC has unilaterally and unconstitutionally recommended that the Defence Services should now be equated to CPOs or para military service, which is two rungs below.

The Signals War Memorial in Jabalpur Cantonment is dedicated to the Personnels of Corps of Signals who have laid down their lives in service of the Corps and Country in the pre and post-Independence era including World War I and II. 1.              While in service, we planned for all contingencies which might occur, whether in official or personal matters. However, after retirement many of us do not display the same meticulousness in our personal affairs. We feel that we still have plenty of time to go and will place our affairs in order In due course of time. When the unexpected happens, the NOK are left to clear an unimaginable tangle of legal and financial issues. It is obviously our responsibility towards our loved ones to organise our personal affairs, while we are still in good health, so that our NOK can receive assets as smoothly as possible. Some measures to ensure this are enumerated in succeeding paragraphs.

    ENDORSEMENT OF  DATE OF BIRTH AND NAME  IN PPO OF YOUR SPOUSE AS FAMILY PENSIONER

   The PPOs issued before 1990 did not have the name of the spouse mentioned as the family pensioner after the demise of the pensioner. It was a problem to have  the family pension commenced and took many months in the procedure.  However,  post 1990 the PCDA began showing only the name of the spouse in the PPOs so that the family pension can begin without a break on the demise of the pensioner.
        On implementation of the recommendations of 6 CPC on enhancement of pension on being Super Sr Ctz was sanctioned for the Family Pension also at par with the pensioners i.e on attaining the age of 80, 85, 90, 95 and 100 yrs.
