SPOUSE NAME MISMATCH- CORRECTION / CHANGE

MISMATCH OF SPOUSE's NAME -- We have recently noticed that there are far too many cases among not only the JCOs & ORs but also among the officers where the names of their Spouse or the beneficiary children mentioned in the official Service records specially the PPO, of the Service Personnel do not match in Toto with the Government issued identity cards/certificates (IDs). It leads to serious problems for the family when the time for the family pension comes. It may take 6 to 12 months before the problem is sorted and the spouse or the family member finally gets the family pension.
We therefore are posting the detailed actions which need to be taken by the veterans while still in good health have the mismatches corrected. Let us first understand as to the Correct Official name of any individual. The name and the date of birth as written in the tenth class certificate is the first and topmost to legally accepted to reckon with,

COMMISSIONED OFFICERS

WHAT IS MEANT BY  COMMISSIONED

Sadly and regretfully,  we the Armed Forces Officers  neither know the meaning of being a "commissioned" officer nor it is a part of our curriculum in the Training Academies or the officer’s courses at any level. You as a commissioned officer are the only category who get a commissioning parchment stamped in the name of the President, earlier it was the King or the Queen who stamped the parchment. By tradition the President uses his stamp and does not sign. No civil servant of even the so called organised Group “A” Officer gets anything like this. They get an appointment letter signed by some Under Secretary in their department.

A commission carries with it the authority of the Constitution to exercise the powers of the State so  vested in the President as mandated, specially of the command of soldiers.

In the Budget 2019, the government made certain changes to income tax rules on investment in the National Pension System (NPS). Union Finance Minister Nirmala Sitharaman increased the income tax exemption limit on withdrawal from NPS and announced some additional income tax benefits for employees who contribute towards the scheme. In NPS, which is a government-sponsored savings scheme, a government employee contributes towards pension from the monthly salary, whereas a matching contribution is made by the employer.

1.  As you know PCDA(P) has upgraded their system and are no more issuing the paper PPOs. The system has been activated by them along with CPPCs of the Pension Paying Banks to issue E-PPOs incl the Pensioners. You can now get your 7 CPC latest Corrg PPO in the comfort of your home after registering with MP 5&6 web site called RODRA . It is a very simple process which is being outlined in this post to guide you to go through the steps to register, log in and downloading  your E-PPO. 
2. E-PPO has now become essential document to get ECHS 64 kb card. In all future correspondence with PCDA (Pensions) Allahabad or PCDA (O) Pune, you need to quote your E-PPO No. You can also call PCDA (Pensions) Allahabad and find out your E-PPO No and Notional pay as on Jan 2016.

2. Article 34:- Gives military a political executive authority to intervene by declaring martial law only to restore democracy. In India parliamentary democracy is supreme. This article makes Indian military as soldiers totally committed to democracy and "we the people".

PLEASE REMEMBER THAT The wife is not the only Natural Heir of the person, after the death of the officer all his properties will be distributed equally among his wife and children.  It is equally valid in case of the wife as well. The Indian succession Act a copy of which is available on this site is very clear on this distribution to all the legal heirs. The big question here is whether you will not like to leave your wife as MASTER and absolute owner of all your assets or leave her to share your assets with children thereby denying her the right of being an independent QUEEN in her remaining life, rather than being partly or wholly dependent on children.

Dear Brig Dhand Sir,

1.      A number of members and non-members of TSEWA have been requesting me to explain NFU in simple terms and how does it affect serving and retired officers of Armed Forces. I have taken inputs from Col Mukul Dev’s table of empanelment of IAS Officers of various batches to the post of Director / Joint Secretary / Additional Secretary in central government and how Organized Group A services are benefited of higher pay by NFU.

I also used data available from SAI 2 / S / 2008, Circular 555 of OROP – 2013 and New Defence Pay Matrix issued in the form of Gazette Notification dated 22 June 2017 to arrive at approximate pay of all Officers as on 01 Jan 2016.

PAN - AADHAAR LINKING

The Income Tax (IT) Department has made it easy for taxpayers to link their PAN with Aadhaar. Responding to grievances of taxpayers regarding difficulties in linking PAN with Aadhaar as their names did not match in both systems (e.g., names with initials in one and expanded initials in another), the IT Department has come out with a simpler options  solution now. These are explained in the image placed along side. please click this image to Zoom and Read. The most simplified facility is by sending a SMS in the format given in this image. Even if there is monor mismatch in the names on Aadhaar and PAN it can still be linked.

  There are other options too as explained.

FAMILY PENSION - BRIEF

1.       Family Pension. The families of the Armed Forces personnel are granted familypension on the death of a service person/pensioner. Family pensions are of three kinds, namely, Liberalized Family Pension, Special Family Pension and Ordinary Family Pension. The eligibility and conditions under which these pensions are granted are given at GOI/MOD letter No. 1(2)/97/D (Pen-C) dated 31 January 2001. These provisions are also discussed in the succeeding paragraphs. Liberalised family Pension (LFP) 2.           Eligibility. The eligibility criteria are as follows:-

(a)          Death or disability due to acts of violence/attack by terrorists, anti-social elements, etc whether on duty other than operational duty or even when not on

6.      The displayed name may not be the one one may be looking for. The lower portion of the window displays one earlier name in the matrix and three following names in serial number of the main display of the above searched name. Check if your desired name is there. If it is there repeat the search with the desired name, One will get the complete data base displayed.

7.    However in case the desired name is not there then repaeat the search with the lat lowermost name.

1.         R&W Section(Corpus)/DIAV provides education grant to the wards of soldiers who die in harness.  It  also includes suicide cases and there is no bar on number of children.  Education grant is presently available for the academic year 2017-18.  Last date of submission of documents is   30 Nov 2018.  Application forms can be sent directly to R&W Section, and there is  no requirement of authentication from  Zila Sainik Board.  Details of welfare schemes/grants are as under :-

ITR FILING FOR THE DECEASED TAX PAYER

FILING OF INCOME TAX RETURN OF THE DECEASED PERSON

 In the eventuality of the death of a TAX PAYER his/her last return is required to be filed by the legal heir after getting him/her self registered on the Income Tax Efiling site. The responsibility of payment of tax rests with the legal heir. There have been cases where the IT Dept has raised demand after three to four years from the Family pensioner.    It is therefore necessary to file his/her last return. The method is not complicated and is described below in the succeeding paragraphs.

FAMILY PENSION FOR DAUGHTERS

ELIGIBILITY OF UNMARRIED / WIDOWED / DIVORCED DAUGHTERS FOR GRANT OF FAMILY PENSION

          In accordance with clauses (ii) and (iii) of sub-rule (6) of Rule 54 of the C.C.S. (Pension) Rules, 1972 read with clause (b) of Para 7.2 of this Department’s O.M. No.45/86/97-P&PW (A)-Part I dated the 27th October 1997, son/daughter including widowed/divorced daughter shall be eligible for grant of family pension till he/she attains the age of 25 years or up to the date of his/her marriage/remarriage, whichever is earlier (subject to income criterion to be notified separately). In this connection Govt Letter dated 30 Aug 2004 referes which is reproduced towards the end of this post..

The above provisions were modified with effect from 06 Sep 2007, wherein the unmarried daughters above 25 years of age are also eligible for pension at par with widowed/divorced daughters subject to other conditions being fulfilled and in case  there is no disabled child to receive the family pension.

Step 1: work out Notional pay as on 1.1.1996 = LPD at the time of retirement + DA as on 1-1- 1996 was 148 % up to Rs.3500 BP and 111% for BP Rs.3501 to 6000 with minimum of Rs.5180 + IR 1 Rs 100/- + IR II =10% of BP (min Rs100) + 40% fitment benefit sum total be placed in appropriate stage in the 5th CPC scale corresponding to the scale from which retired

During service one had a functional office as well as administrative support which just vanished in thin air, in a short while after one's farewell to arms.
2. Are you, for sure, aware as to what all forms you filled up and sent to AG's branch six months before your superannuation. Wasn't it your Head Clerk who liaised with another unit to copy all these documents from the ones belonging to another recent retiree. Our ignorance would surely lead to many issues which will crop up in a few years. We will then be bash our head here and there to rectify what could have been done easily immediately after retirement. (CONTD)

1.       A large number of pensioners/family pensioners have been facing the problem of delayed payments by banks or paying lesser pension than their entitlement. It's been found to be a very very common problem particularly faced by the Family Pensioners who are generally not aware of their entitlements and the system which pays them the pension. We have seen my pensioners and Family pensioners running to their banks and virtually begging the bank clerks to look into the payments and corrections whereas they are duty bound by explicitly laid down rules too pay the correct pension without any claims from us. The attitude of the bank clerks in most of the banks has generally seen to be rude and indifferent as if they are the ones who are giving the pension to them. (Contd -click below) ----- 

LINKING AADHAAR AND PAN - Simplified

Income Tax (IT) Department simplifies linking PAN with Aadhaar for taxpayers using Income Tax India website. No need to login or be registered on the E-filing website for linking
The Income Tax (IT) Department has made it easy for taxpayers to link their PAN with Aadhaar. Responding to grievances of taxpayers regarding difficulties in linking PAN with Aadhaar as their names did not match in both systems (e.g., names with initials in one and expanded initials in another), the IT Department has come out with a simple solution now.Taxpayers can go to "http://www.incometaxindiaefiling.gov.in/" and click on the link on the Link Aadhaar, provide PAN, Aadhaar number and ENTER NAME EXACTLY AS GIVEN IN AADHAAR CARD (avoid spelling mistakes) and Submit. One can also direclty reach the page  for linking  your aadhaar with your PAN  clicking on "Link Aadhaar" or by selecting the option under services section in their home page.

RELIEF ON INCOME TAX ON ARREARS OF OROP-2

1.  There have been Many queries from our readers on as to how to work out relief on Arrears of OROP fourth installment, which had been received during the FY 2023-24 while filing the ITR for the current Assessment Year  before 31st of Jul 2024

       NOTE : Just to remind the readers  not to delay filing your return this year as the

 Income Tax department will charge you delay penalty of Rs 5000/- . It is no Rocket

 science but a child’s play. It is very very easy to file the ITR on line, child's play because

 your data is prefilled by the portal and all calculations are done automatically, you

 need to  just put in figures of your pension and income from other sources rest is done

 by the on line software, do veryfy the figures as per interest certs received from the

3.  The installments of OROP-2 lif pertain to the FY 2023-24 will add to your income hence the Tax. 
4.   One can claim rebate to the extent what we would have paid had the arrears were received during the year to which they pertain to. This all done on line while filing the ITR by filling up Form 10-E. However first and foremost carry a check whether it will be of some benefit or not.

5.   It will be beneficcial only if in the previous years you were ina lower bracket.
