TAX EXEMTION FOR PERSONS WITH DISABLITIES

Tax Exemption For Disabled Persons,
The Income Tax Act and the Profession Tax Act provides various income tax deductions under Section 80DD, 80DDB and 80U for differently-abled (disabled and handicapped) people.
Most states in India allow a professional tax exemption for any person suffering from a permanent disability.
Section 80DD
Under Section 80DD the expenses on maintenance/ medical treatment of disabled dependents can be claimed as an income tax deduction. Dependents include spouse, children, parents, brothers and sisters and the income tax deduction is valid only if they have not already claimed a benefit under Section 80U. Income-tax Deduction for expenses for partially disabled dependents (severity 40-80%) is allowed up to Rs.75,000 while it goes up to Rs 1.25 lakh if the dependent is over 80% disabled. The plus side is that even if your actual expenses are lesser than Rs 75000 you can claim a full deduction.

CONSTITUTIONAL STATUS OF ARMED FORCES

CONSTITUTIONAL - STATUS OF ARMED FORCES

Para 310 of the Constitution reads,
"310. (1) Except as expressly provided by this Constitution, every person who is a member of a defence service or of a civil service of the Union or of an all-India service or holds any post connected with defence or any civil post under the Union holds office during the pleasure of the President, and every person who is a member of a civil service of a State or holds any civil post under a State holds office during the pleasure of the Governor 3*** of the State. (2)"

Our understanding of the sentence, would place the member of the Defence Service on top of all others, followed by the civil services and then  by all India services.

Apparently the makers of the constitution had this order in mind, when the above sentence was framed. The meaning of the constitution is quite clear and has clearly indicated the order of precedence. There has been no amendment to this act. 

Any other  office order by the Govt of India which is not in line with the above constitutional provisions is unconstitutional and can be struck down by the Honourable Supreme Court of India.

Keeping this in my mind, it is surprising that the 7CPC has unilaterally and unconstitutionally recommended that the Defence Services should now be equated to CPOs or para military service, which is two rungs below.

1.              While in service, we planned for all contingencies which might occur, whether in official or personal matters. However, after retirement many of us do not display the same meticulousness in our personal affairs. We feel that we still have plenty of time to go and will place our affairs in order In due course of time. When the unexpected happens, the NOK are left to clear an unimaginable tangle of legal and financial issues. It is obviously our responsibility towards our loved ones to organise our personal affairs, while we are still in good health, so that our NOK can receive assets as smoothly as possible. Some measures to ensure this are enumerated in succeeding paragraphs.

ENDORSEMENT OF DOB OF SPOUSE IN PPO

    ENDORSEMENT OF  DATE OF BIRTH AND NAME  IN PPO OF YOUR SPOUSE AS FAMILY PENSIONER
   The PPOs issued before 1990 did not have the name of the spouse mentioned as the family pensioner after the demise of the pensioner. It was a problem to have  the family pension commenced and took many months in the procedure.  However,  post 1990 the PCDA began showing only the name of the spouse in the PPOs so that the family pension can begin without a break on the demise of the pensioner.
        On implementation of the recommendations of 6 CPC on enhancement of pension on being Super Sr Ctz was sanctioned for the Family Pension also at par with the pensioners i.e on attaining the age of 80, 85, 90, 95 and 100 yrs.

OROP IMPLEMENTATION INSTRUCTIONS

         The implementation instructions have also been issues within 24 hrs of the issue of the MOD (DESW) Letter of 03 Feb 2016 vide PCDA(P) Circular Number 555 dated 04 Feb2016 to the Banks and other Pension Disbursement Agencies (PDAs). The Circular can be viewed / downloaded from their web site by opening the URL as under :-

       The circular also has the MOD letter as an attachment to it. The circular gives comprehensive instructions to the PDAs to check the rank groups qualifying service of the pensioners from their PPOs and then pay as per the relevant tables as explained there. IT HAS BEEN HOWEVER ALLEGED THAT CERTAIN CONDITIONS WHICH ARE NOT THERE IN THE GOVT LETTER HAVE BEEN IMPOSED BY PCDA ON ITS OWN THERE BY DENYING THE RIGHTFUL PENSION TO JCOs & ORs
        The PDAs are initiating action to make OROP payments to the pensioners with necessary Dearness Relief.. No application is also required from the pensioners.
                                              

OROP SCHEME - TABLES (OFFICERS)

                        HOW MUCH HAS YOUR PENSION BEEN ENHANCED (INCL %age) ?
     The much awaited tables have since been issued as part of implementation of the OROP. The Table for Officers are placed here in this post. The tables for Medicos  are also  hosted  for our Doctor Fellow Veterans of Pre-2006 retirees. The tables for various types of Family Pensioners can also be accessed with links at the end of this post.
   The Govt letter and detailed tables can be downloaded from  http://www.desw.gov.in/sites/upload_files/desw/files/pdf/2016.02.03-OROP.pdf . The letter containing tables is a large pdf file of about 15 Mb. It has 205 pages incl 101 Appces of Various tables covering all aspects of pension for officers, JCOs & ORs and their equivalent ranks.

        With implementation of the OROP the Qualifying Service is now a very important factor for all Pensioners and Family Pensioners. The QS as mentioned in your PPOs is to be considered by the PDAs while fixing your pension under the OROP Scheme. It is therefore important that you must check the same in your PPOs for correctness as per your Records of Service.

Whenever any retiring officer approaches us for advice, invariably the question of whether or not to commute the pension comes up. This article deals with this issue so that all officers, retired or retiring, would be able to make up their mind more knowledgeably.


Commutation is defined as giving up part or all of the pension payable from retirement in exchange for an immediate lump sum. Commutation factors (usually calculated by the Scheme Actuary) are used to determine the amount of pension which needs to be given up in order to provide the lump sum.

HISTORY OF PENSION

Before 1-4-1927, the grant and audit of pension payments was the responsibility of respective pension sections of various Controllers of Military Accounts. From 1-4-1927, the pension work relating to Northern and Eastern Commands was centralised in the office of the Controller of Military Pension Accounts, Northern and Eastern Commands at Lahore. An office similar to the one at Lahore was also formed at Mhow a little later for dealing with all pension claims of Southern and Western Commands. With a view of securing uniformity of procedures. with regard to sanction and audit to pension, both the Central Pension Offices at Lahore and Mhow were subsequently amalgamated and located at Lahore only.

FAMILY PENSION 
1.       Ordinary Family Pension. Ordinary Family pension is entitled to the widow and after her death, to eligible children, in case of death of the officer who was in receipt of pension. A son is entitled for Family Pension upto 25 years of age/marriage or earning more than Rs. 3500/- per month. Unmarried/Widowed/divorced daughters are entitled to family pension for life, or till their re-marriage/earning more than Rs. 3500/- per month. The PPO issued to an officer on retirement includes family pension admissible to the widow of officer in case of his death. In such cases, the widow is only required to intimate the death of her husband to the Pension Disbursing Authority

HOW EAST PAKISTAN SURRENDERED - 1971

How east Pakistan surrendered               BY   Lt Gen JFR  Jacob.   
  Though no war goes completely according to plan, this one went  off reasonably well, and on December 13, we were outside Dhaka.
The advance from the north went off well, and though the move of the two brigades was delayed the paradrop took place as planned. By December 13, we had about 3,000 troops outside Dhaka.
Meanwhile the American fleet was moving into the Straits of Malacca. Some in Delhi were panicking. The radio signals we were intercepting from Islamabad to the Pakistani forces in the east said "Fight on, you are getting help from yellow (China) from the north, and white (America) from the south."

Dear Veterans,
          Please note that there is "Rule 5" under the "Payment of Arrears of Pension (Nomination) Rules, 1993" and also Def Pension Instructions at page 206, which is not known to most of us, the LNomination for Life time Arrears has been dealt at length.  It has been authentically confirmed from PCDA (Pensions) that the Rules do not permit payment of Life Time Arrears , if any, which may accrue, pertaining to the period of when the pensioner was alive, after his/her demise, unless there is a proper nomination made by the pensioner/family pensioner to the effect during his life time.
          In cases where there is no nomination the procedure to get the arrears is  tortuous as the legal heirs will need to get succession certificates from the court. 
          Apparently, payment of arrears is governed differently from the payment of family

  1.    The demise if a veteran (pensioner) is a most traumatic moment for his  NOK. No words can ameliorate the pain and suffering of the moment. However, the NOK or the legal heir should realise the need to concentrate on the immediate requirements to ensure the orderly transition  without the veteran / pensioner.

2.   The actions which are required to be taken after the demise of the pensioner or family pensioner can be  immediate and then the subsequent. The immediate actions relate primarily related to the death certificate and cremation whereas the subsequent actions will be more official. The family friends generally come forward to take on the immediate actions on themselves since the family would be traumatized with the demise. A check list is placed at the end of this document which can serve as a ready reckoner.

         It is not that you alone are suffering but many Ex-Servicemen are there who are in similar predicament due to ignorance of bank staff regarding Defence pensions and partial discharge of their duties by PCDAs (Pensions) of the  three services. The result is Defence pensions payment is in total mess and ESMs specially the Family Pensioners  are suffering for no fault of their. 90% of JCOs, OR and family pensioners do not get their entitled pensions as bank staff do not have the required  knowledge to calculate current and correct pensions.
        All pre - 2006 Defence pensioners irrespective of date of retirement have been treated for purpose of pension as if they all retired as on 31 Jan 2006. Therefore pension of all such faujis is equal to what a serving soldier retiring on 31 Jan 2006 immediately


FAMILY PENSION - DETAILED BRIEF

1.       Family Pension. The families of the Armed Forces personnel are granted familypension on the death of a service person/pensioner. Family pensions are of three kinds, namely, Liberalized Family Pension, Special Family Pension and Ordinary Family Pension. The eligibility and conditions under which these pensions are granted are given at GOI/MOD letter No. 1(2)/97/D (Pen-C) dated 31 January 2001.
